Legal Notices

Effective date — October 7, 2026 (version 2)
01
Overview

This page brings together the legal notices and disclosures that apply to your use of Swop's websites, applications, and services. It should be read alongside our Terms & Conditions and Privacy Policy, which together govern your relationship with Swop Technologies Inc. (“Swop”), which operates swopme.co, the Swop app at swopme.app, and the Swop mobile apps. The Terms include a binding individual arbitration agreement and class action waiver, with a 30-day opt-out; see section 12 of the Swop Terms of Service.

02
Legal Documents

The following documents form the agreement between you and Swop Technologies Inc.: the Terms & Conditions, which set out the rules for using the platform; the Privacy Policy, which explains how data is collected and used; the Seller Agreement for Card Payments, which applies only to sellers who accept card payments; the Community Guidelines, which set out what content and behavior are not allowed and how to report or block a user; and any additional terms presented to you for specific features. For help with any of these, visit our Support page.

03
Self-Custody Disclosure

Swop provides self-custodial software. Swop wallets are embedded wallets provided through Privy. Swop does not take possession of the funds in your wallets, does not hold your private keys, cannot recover them, and cannot reverse transactions once they are confirmed on-chain. If you choose to grant Swop a delegated signing permission (for example, for an agent or automation), Swop can sign the transactions that permission allows until you revoke it. Losing access to your login or recovery credentials may result in the permanent loss of your assets.

Two kinds of checkout payment are not self-custodial: card payments (see the next section) and crypto checkout payments that are received into a Swop-controlled settlement wallet, converted to USDC where needed, and then forwarded to the seller.

04
Card Payment Disclosure

Card payments are being introduced gradually and are not yet available to every seller. Where Swop has enabled them, sellers may accept card payments alongside crypto. Card payments are not self-custodial. Swop is the settlement merchant for card charges: the card is charged by Swop through its payment processor, Stripe, and Swop then pays the seller. A buyer who cannot resolve a card purchase with the seller may dispute the charge with their card issuer, and that dispute is raised against Swop. Card payments can be refunded to the original card, in whole or in part; crypto payments cannot be reversed. Card details are entered into Stripe's own form and never reach Swop. Sellers must complete Stripe's identity verification, and accept the Stripe Connected Account Agreement and the Seller Agreement for Card Payments, before they can be paid by card — requirements that apply to card payments only, never to crypto or x402 payments. The full terms are in our Terms & Conditions and our Privacy Policy.

05
Risk Disclosure

Digital assets are volatile and may lose some or all of their value, and a stablecoin can lose its peg. Blockchain transactions are irreversible, and smart contracts, bridges, swap routers, and escrow or settlement arrangements — including those used by Swop — may contain bugs, be exploited, or behave unexpectedly. Past performance of any asset is not indicative of future results. You should only transact with funds you can afford to lose.

Prediction-market and perpetual-futures features route orders to third-party venues (such as Polymarket and Hyperliquid) that Swop does not operate, and their own rules apply. Prediction-market positions can expire worthless and you can lose your entire stake; leveraged positions can be liquidated. Output from Swop's AI features can be wrong and is not advice.

06
No Financial, Legal, or Tax Advice

Nothing on Swop's websites or applications constitutes financial, investment, legal, accounting, or tax advice, or a recommendation to buy, sell, or hold any digital asset. All content is provided for informational purposes only. You are responsible for your own decisions and for complying with the laws and tax obligations of your jurisdiction.

07
